Acceptance of the general sales conditions

1. The contract stipulated between ELISIR LIFE S.R.L. and the Customer must be considered concluded with the acceptance of the order by the selling company. This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways envisaged, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below.

2. If the Customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity), once the online purchase procedure is completed, he will print or save an electronic copy and in any case keep the present general conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree 185/1999 on distance selling, and subsequent additions and amendments.

3. Any right of the Customer to compensation for damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order is excluded.

How to purchase

4. The Customer can only purchase products in the electronic catalog of ELISIR LIFE S.R.L. at the time of placing the order and viewable online at (URL) http://www.elisirlife.it, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its features but may differ in features, color, dimensions and accessory products shown in the figure. All purchase support information (Glossary, Buying Guide, etc.) is to be understood as a simple generic information material, not referable to the real characteristics of a single product.

5. Correct receipt of the order is confirmed by ELISIR LIFE S.R.L. by an e-mail reply sent to the e-mail address communicated by the Customer. This confirmation message will contain date and time of execution of the order and a "Customer Order Number", to be used in any further communication with ELISIR LIFE S.R.L. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, in the manner described in this document.

6. In case of non-acceptance of the order, ELISIR LIFE S.R.L. guarantees timely communication to the Customer.

7. In case of non-execution of the order due to the unavailability, even temporary, of the goods, ELISIR LIFE SRL, within thirty (30) days starting from the day following the day on which the Customer sent the order through the site web www.elisirlife.it, will inform the Customer and will refund any amounts already paid for the payment of the goods.

Terms of payment

7. PayPal In the case of purchase of services with PayPal payment method, together with the conclusion of the online transaction, PayPal will immediately debit the amount of the purchase made.

7.1 In case of cancellation of the order, both by the Customer and in case of non-acceptance by ELISIR LIFE S.R.L., together with the cancellation, the amount of the canceled orders will be credited back to the Customer's Paypal account. The crediting times on the payment instrument chosen within the Paypal account depend exclusively on PayPal and the banking system. Once the amount has been credited back to the Paypal account, in no case ELISIR LIFE S.R.L. can be held liable for any damages, direct or indirect, caused by delays in the actual re-credit dependent on Paypal or the banking system.

7.2 ELISIR LIFE S.R.L. reserves the right to request additional information from the Customer (eg fixed telephone number) to determine the actual ownership of the PayPal account. In the absence of the required documentation, ELISIR LIFE S.R.L. reserves the right to refuse the order.

7.3 At no time during the purchase procedure ELISIR LIFE S.R.L. is able to know the information relating to the buyer's credit card or other chosen methods within the PayPal wallet. In no case ELISIR LIFE S.R.L. can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of products purchased on the ELISIR LIFE S.R.L. website

8. Cash on delivery (only for certain products) Payment on Cash on Delivery is only for orders below 1000.00 (one thousand) and must be made exclusively with cash or by CIRCULAR check made out to ELISIR LIFE S.R.L. who will deliver (will not be accepted by the BANK courier checks). 10% of the total amount must be paid as an advance payment. The remaining part will be paid upon delivery of the goods. The communication to the Customer of which courier will be in charge of the delivery will be made in the manner provided on the site. Nothing more than what is indicated at the time of the order will be due by the Customer.

9. Advance Bank Transfer The Advance Transfer form of payment is possible on all items in the catalog. Any limitations are clearly highlighted in the shopping cart. In case of payment by Advance Bank Transfer, the order ordered by the Customer will be kept busy until receipt of proof of payment, to be sent to ELISIR LIFE S.R.L. (by fax or e-mail) no later than 3 working days from the date of acceptance of the order. The sending of the order will take place only when the actual crediting of the amount due on the current account of ELISIR LIFE S.R.L. which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order will be deemed automatically canceled. The purpose of the bank transfer must include:

• the order reference number;

• the date of the order;

• name and surname of the order holder.

Delivery methods and costs

11. For every order placed on the site www.elisirlife.it, ELISIR LIFE S.R.L. issues a tax invoice or receipt of the material sent, sending it via e-mail or by mail to the order holder, pursuant to Article 14 of the Decree 445/2000 and DL 52/2004. For the issuance of the invoice, the information provided by the Customer at the time of the order is binding. No change in the invoice will be possible after the issuance thereof.

12. The delivery costs indicated in each product sheet are charged to the Customer. For the islands it is necessary to establish an ad hoc shipping cost. The payment of the goods by the Customer will be made using the method chosen when ordering. Nothing is more due by the customer than the total order.

13. No responsibility can be attributed to ELISIR LIFE S.R.L. in case of delay in the order or delivery of the order.

14. Delivery is at street level, by appointment. Instead, the Customer is required to check:

• that the number of packages delivered corresponds to what is indicated in the transport document;

• that the packaging is intact, not damaged or wet or otherwise altered, even in the closing materials (adhesive tape or metal straps).

Any damage or mismatch in the number of packages or indications must be immediately reported to the courier who makes the delivery. Once the courier's document has been signed, the Customer will not be able to oppose any dispute about the external characteristics of what was delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set forth in this document.

15. In case of non-collection within 5 working days of the material in storage at the courier's warehouses due to repeated inability to deliver to the address indicated by the Customer at the time of ordering, the order will be automatically canceled.

Right of withdrawal

16. According to the art. 64 of the Legislative Decree No. 206/2005, and subsequent additions and modifications, if the customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase indicating a VAT reference in the form of order present on the website in question), has the right to terminate the purchase contract for any reason, without explanation and without penalty, except as indicated in the following point 20.

17. To exercise this right, the customer must send ELISIR LIFE S.R.L. a communication to that effect, within fourteen (14) days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt addressed to:

or by telegram or fax always sent within the aforementioned term of fourteen (14) days and followed by a confirmation by registered letter with acknowledgment of receipt, sent ABSOLUTELY within the following 48 hours. Once we have received the aforementioned withdrawal notice, ELISIR LIFE S.R.L. will quickly inform the Customer of the instructions on how to return the goods, which must be received within fourteen (14) days of authorization.

18. The right of withdrawal is in any case subject to the following conditions:

• the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, part of household appliances, etc.);

• for supplements and perishable foodstuffs, the right of withdrawal is not applicable if the product has been opened or used; therefore it must be returned with the seal intact;

• the product purchased must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment);

• by law, the shipping costs for returning the goods are charged to the Customer;

• the shipment, until the certificate of receipt in our warehouse is under the full responsibility of the customer; in case of damage to the goods during transport, ELISIR LIFE S.R.L. will notify the Customer of the incident (within 5 working days from receipt of the good in its warehouses), to allow him to file a timely complaint against the courier chosen by him and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal;

• ELISIR LIFE S.R.L. does not respond in any way for damage or theft / loss of goods returned with uninsured shipments;

• on arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, ELISIR LIFE S.R.L. will deduct from the reimbursement due a percentage, in any case not exceeding 10% of the same, as a contribution to the costs of restoration.

19. Without prejudice to any repair costs for damage to the original packaging, ELISIR LIFE S.R.L. will reimburse the customer the full amount already paid, in the shortest possible time and in any case within fourteen (14) days from the date on which the consumer received the communication of the right of withdrawal. The reimbursement will be made by transferring the amount charged to the credit card or by bank transfer. In any case, the Customer shall promptly provide the necessary and useful data to obtain a refund.

20. The right of withdrawal is lost for lack of the essential condition of integrity of the good (packaging and / or its content), in cases where ELISIR LIFE S.R.L. finds:

• lack of external and / or internal packaging;

• the absence of integral elements of the product (accessories, manuals, parts, ...);

• damage to the product for reasons other than transportation.

In case of forfeiture of the right of withdrawal, ELISIR LIFE S.R.L. will return the purchased good to the sender, charging the shipping costs to the sender.

Privacy

21. The personal data requested at the time of placing the order are collected and processed in order to satisfy the express requests of the Customer and will in no case and in no way be transferred to third parties. ELISIR LIFE S.R.L. guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code pursuant to Legislative Decree 196 of 30.06.03. The data controller is ELISIR LIFE S.R.L.

Complaints

22. Any complaint must be addressed to ELISIR LIFE S.R.L., VIA CINQUEFRONDI, 114/116 - 00173 ROMA.

Applicable law

23. For everything not expressly foreseen and not provided, the parties make explicit reference to the national and community, ordinary and special regulations regarding sales, consumer rights and e-commerce. The sales contract between the Customer and ELISIR LIFE S.R.L. means concluded in Italy and regulated by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial competence is that of the reference forum of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Rome.
